    These general terms and conditions apply to all deliveries from Tanja Pede -PEDEcreative- (hereinafter PEDEcreative) to consumers. My online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed.
    • Applicable law: In principle, all provisions of the law of the Federal Republic of Germany and the European Union apply, unless otherwise agreed in these General Terms and Conditions.

• • conclusion of contract
    • The presentation of the products in the online shop does not constitute a legally binding offer, but only a non-binding online catalogue.
      
    • You can first save the products in the shopping cart and edit them further as part of the ordering process.
    • By clicking the [Buy] button, you make a binding purchase offer for the goods listed on the order page. Your purchase contract is concluded when we accept your order with an order confirmation via e-mail immediately after receiving your order/we have the goods delivered. Depending on which event occurs first.
    • The range of goods is limited. The reason for this is that both my time and available ingredients/materials for crafting are limited. As a rule, it will no longer be technically possible to place another order once the upper limit has been reached. You may try again at a different time. I will be happy to send you the next shop update date via the newsletter function.
    • Possibility of individual production (custom order): An individual production (custom order) is a pre-order, hence the explicit note that the production can take up to 4 weeks. Depending on the weather (e.g. rain, fog, etc., particularly unfavorable with watercolors), the production time can be extended up to 6 weeks. If there are free capacities, I will send you an email for confirmation. Basically, I try to send the items to you in a high-quality condition as quickly as possible. Customization capacities are limited as time and materials are limited. An individual production can be requested by e-mail or contact form.

    • The contract language is German

• • Right of withdrawal/Return/Refunds
    • According to the law, you have a 14-day right of withdrawal. You can find more information and a template under the Right and Instructions of Withdrawal.
      
    • Costs for the return are borne by teh buyer
    • Refunds are made after receipt of the goods in the same way as the payment

  • prices and shipping costs
    • All prices are shown in Euro. Because I am a small business owner, the small business regulation applies. This means that according to § 19 UStG I do not show any value added tax (VAT). Shipping costs will be calculated individually within the ordering process.

  • Delivery/Shipping
    • The dispatch takes place within 3-5 working days after order.
    • Deliveries are preferably made within Germany and the European Union with DHL. If a different shipping method is desired, please contact me so that I can check the request and, if necessary, set it as a new shipping method in the ordering process.
    • The delivery time is up to 3 days for Germany and up to 14 days in the European Union (depending on the country).

• • Transportdamages

• • • If goods are delivered with obvious transport damage, please complain about such errors as soon as possible to the deliverer and please contact us immediately. The failure to make a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.

    • Payment is preferably made via the payment service providers PayPal or Stripe.
    
    
    • If payment by PayPal or Stripe is not possible, please contact me.

• • Ownership
    
    
    • Until full payment, the goods remain our property.

  • Warranty

• • • • Liability for defects: The statutory warranty law applies.
  • Handmade paints may have air pockets or cracks. Despite careful manufacture and strict monitoring, this cannot be completely avoided and is a sign of genuine manual work and not a lack of quality. The colors are still perfect to use. If, despite high quality standards, there is a larger cavity in your colors, you are welcome to contact me. We will surely find a solution!

  • Liability​​​​​​​

    We shall always be liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents.

    • in the event of injury to life, limb or health,
    • in the event of intentional or grossly negligent breach of duty,
    • in the case of guarantee promises, if agreed, or
    • insofar as the scope of application of the Product Liability Act has been opened.

    In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely, (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
    Otherwise, claims for damages are excluded.

    I would like to expressly point out once again that the items sold are to be used as intended and properly. In particular, the colors sold are not suitable for consumption. They are used exclusively for the creation of artistic works. Therefore, the request to observe all precautions, especially after use, to wash hands and, if possible, not to eat and drink during artistic work.  I cannot accept any liability for any damage resulting from the use, in particular the improper use.

• • • Information on data protection can be found in our privacy policy.

• • • Links to external websites, including social media applications, have been checked at the time of creation of this website, but we have no influence on how their content changes in the future. In addition, the user(s) leaves the scope of this website if he/she clicks on a link, which may mean that operators of the websites/web offers to which the link leads can collect data themselves. Here it is the responsibility of the user to inform himself or herself about their data protection guidelines.

The platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts.
